Step-by-Step Procedure

Stage 1:
Step 1. Landowner contacts local land trust and requests information packet
(includes brochure,
questionnaire, step-by-step
procedure)
Stage 2:
Step 2. Landowner returns completed questionnaire
Step 3. Land committee reviews questionnaire and decides whether or not to
pursue the conservation easement
Step 4. Land committee members schedule tour of property with landowner
Step 5. Land committee makes recommendation for the easement to Wood-Land-Lakes' Council and
notifies landowner of decision
Stage 3:
Step 6. Wood-Land-Lakes advises the landowner to consult legal and tax advisors
Step 7. Landowner obtains qualified appraisal (NOTE: date of appraisal
should be within 60 days of recording the easement or the appraisal will
need to be re-certified)
Step 8. Landowner obtains survey that includes access right of way to the
conservation easement.
Step 9. Landowner obtains title information
Step 10. Landowner negotiates the restrictions and works with us to develop
a Conservation Easement contract document --
agriculture or
wooded (along with natural
habitat of fish, wildlife and plants)
Step 11. Land committee obtains formal acceptance by Wood-Land-Lakes' Council
Stage 4:
Step 12. Council officers and Landowner sign and notarize easement
contract
Step 13. Landowner records easement
Step 14. We complete baseline inventory of the property
Step 15. Landowner provides copies of recorded Conservation Easement to Wood-Land-Lakes and attorney
Step 16. We publicize the results
Stage 5:
Step 17. WLL signs IRS Form 8283 once the information in Section B, Part 1,
"Information on Donated Property," and Part 3, "Declaration of Appraiser,"
is complete
Step 18. Land committee monitors easement annually with landowner |
